Family issues are amongst the most hotly contested in life – and with emotions running deep, not everyone sees things the same way.
The family is all-important to most of us and the decisions you make concerning important issues today can be life-changing tomorrow. Issues must be handled with compassion, sincerity, and clarity.
Whether it’s a matter concerned with marriage, divorce, alimony, child custody support, paternity, or another issue, family law complications can arise. Sometimes, to protect your rights, we need mediation or negotiation and, at other times, it takes a more aggressive approach with litigation.
At Goldstein Flaxman PLLC in Las Vegas, our sole focus is family law. As such, all of our efforts go into helping you resolve your family issues in your best interests and with the minimum of stress and expense.
Our family law practice areas
We can assist with all types of legal issues that affect your family, including the following:
Las Vegas Divorce
Few divorces proceed as smoothly as couples hope. Even with amicable uncontested divorces, negotiation or mediation may be required to reach a settlement. When there are custody, support, and property division disputes, litigation may be required. Whichever applies in your case, we can help.
Las Vegas Alimony/spousal support
During a divorce or separation, one spouse may be eligible for alimony or spousal support to aid the transition to independent life – but this is not automatic. We can help you take the steps necessary to apply for alimony or to modify it if your circumstances change.
Las Vegas Child custody
Nobody, including the courts, wants children to suffer because of a divorce but parents may not see eye to eye on what’s best for their children. We can help you reach an acceptable agreement in the best interests of the children and workable for both parents – or litigate if you are requesting sole custody.
Las Vegas Child support
Child support calculations in Las Vegas can be confusing. We will help you understand your rights and obligations when it comes to paying and receiving child support. We can also assist in submitting the correct documents and supporting evidence to the court for applications or modification requests.
Las Vegas Marriage Annulment
An annulment is a judicial declaration that a marriage was never valid – unlike a divorce, which formally ends a marriage. Such cases are quite common in Las Vegas, where marriages are quick and simple to arrange. We have extensive experience in making applications to the court for an annulment.
Las Vegas Paternity rights
With children from marriages, the spouses are assumed to be the mother and father. However, unmarried parents may have to prove paternity when discussing rights, the establishment of child custody and child support decrees, and modification of court orders. We can assist with this process.
Las Vegas Prenuptial/postnuptial agreements
We can help you protect yourself if you are getting married. Drafting a premarital, cohabitation or domestic partnership agreement is common practice but it needs to be done so that it is legally valid. Otherwise, the specifications you make for divorce or after the death of a spouse may not be enforceable.
What does a family law lawyer do?
A family law attorney will firstly assess your case during an evaluation process.
This will elicit important information about the issue and, from this, the attorney can provide you with an assessment of the legal situation, the options available under Nevada law, and recommended next steps.
You will ultimately decide what is best for you and your family but a family law lawyer will be able to provide advice and guidance on how to resolve the issue. You can then make informed decisions with full knowledge of your rights and obligations.
We will also help you gather supporting evidence to back up your position and present it to your spouse, your spouse’s lawyer, or the court, as becomes necessary.
How do Las Vegas family law cases work?
The majority of family law cases in Las Vegas involve marriage or divorce. These are topics that most people can relate to even if they have never been married themselves.
It is no secret how complex such divorce cases can become. We’ve all seen the movies with long, drawn-out custody battles or disputes over who gets the family home.
Despite this, few divorce cases go to trial in Las Vegas. Every effort is usually taken to provide opportunities for spouses to settle out of court.
While this is not always possible, we are successful in bringing spouses to an acceptable agreement in the vast majority of cases. This keeps the expense, delays, and stress to a minimum.
Nevada is a no-fault divorce state, meaning that the family law court system does not have to apportion blame for the marriage breakdown. This raises the likelihood of settling out of court and we can often bring the parties together in mediation or with collaboration between family law attorneys.
If no agreement is possible about custody, parenting, support or property division matters, we will end up in court with a judge making the decision. But this is generally a last resort after we have explored all other available options.
